INTERACTIONS WITH POLICE

Never leave your home without some kind of ID, preferably a driver’s license but at a minimum a State issued ID.

The only thing you have to tell the police is your true and correct name.

You ALWAYS have the right to refuse to speak to the cops.

Never ever give consent to search your person, possessions, home, or car.

Anytime you speak to the police, assume you are being recorded.

The police are not your friends, they will not help you, they are trained to investigate crimes and are in fact conspiring against you and doing everything they can to build a case against you. So when you are read your Miranda Rights and are told that “everything you say can and will be used against you,” that is the absolute truth.

While you are out on bail waiting for your case to be resolved. You MUST remain silent. Speak to no one, ever about your case and that means in all possible ways in which we communicate.

If incarcerated, DO NOT EVER talk about your case on a jail call. Never, to anyone, not even in a foreign language.

Never speak to the police or sign anything without your attorney.

Anyone that you discuss your case with, other than your attorney, can be subpoenaed later as a witness against you.
DUI

DUI Convictions in Georgia are forever. It can’t be removed from your record
-
You have the right to refuse any test of any type that the officer asks.

Major rental car companies will not rent vehicles to anyone with DUI conviction (length of time varies from 3 to 6 years).

DUI is the only motor vehicle offense that shows up on NCIC database maintained by the FBI.
POST CONVICTION EFFECTS

If on probation, remember that your Fourth Amendment Rights against illegal searches and seizures have most likely been waived, or rather forfeited based on your conviction.

If you are convicted of a drug offense, your license to drive will be suspended also.

If you are convicted a felony, you may also lose some or all of your civil liberties, including the right to vote or own a handgun.
AUTO ACCIDENT

Stay calm and check for Injuries, call an ambulance when in doubt.

If accident is minor, move cars to a safe place, out of traffic.

Turn on your vehicle's hazard lights and use cones, warning triangles or flares for safety.

Call the police, even if the accident is minor.

If someone other than the owner of the vehicle is driving the other car, write down the relationship

Write down information about the Accident (Location, Time of Day, Weather Conditions, Road Conditions, Amount of Traffic, Traffic Control Devices, Posted Speed Limit, etc.)

Make immediate notes about the accident regarding the specific damages to all vehicles involved,

Inform Your Insurance Company

Take Pictures

Talk to Witnesses

Limit the discussion about the Accident

Be polite, but don't tell anyone the accident was your fault, even if you think it was.

Don’t sign any documents, other than police documents.
